Terms of Service

Welcome to Mercy Through Mary ("we", "us", "our"), a devotional platform. These Terms of Service ("Terms") are a legal agreement between you and Mercy Through Mary governing your use of our website, iOS app, and Android app (together, the "Service"). Please read them carefully.

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

These Terms are provided in English, which is their authoritative version. Where the Service is offered in other languages, those translations are for convenience only.

Who may use the Service

You may use the Service if you are able to form a binding contract with us and are not barred from doing so under applicable law. The Service is intended for a general audience and is not directed to children under 13. If you use the Service on behalf of an organisation, such as a parish or group, you represent that you are authorised to accept these Terms for it.

Your account

To use certain features you create an account with your email address. Sign-in is passwordless: we email you a one-time code. You are responsible for keeping access to your email account secure and for activity that occurs under your account. Tell us promptly at privacy@mercythroughmary.org if you believe your account has been used without your permission.

Using the Service

Mercy Through Mary helps you pray, track a Marian consecration, join prayer communities, and access devotional content. You agree to use the Service only for lawful, personal, and devotional purposes, and not to:

  • break any law or infringe anyone's rights;
  • upload or share content that is unlawful, hateful, harassing, obscene, or otherwise objectionable;
  • misrepresent your identity or impersonate others;
  • disrupt, overload, probe, or attempt to gain unauthorised access to the Service or its systems;
  • scrape, copy, or redistribute the Service's content except as expressly allowed; or
  • use the Service to send spam or to solicit others in a way that harms the community.

We may suspend or terminate access that violates these Terms or that harms other users, the Service, or the ministry.

Community features

Groups, rosary circles, events, and similar features let you interact with others. You are responsible for what you post and share. Be charitable and respectful. We may remove content or restrict participation to keep the community safe, but we are not obligated to monitor or review all content.

Content and intellectual property

The Service and its original content — including text, prayers as presented, design, logos, and software — are owned by Mercy Through Mary or its licensors and are protected by intellectual-property laws. Many traditional prayers and Scripture are in the public domain; our particular presentation, translations, reflections, and arrangement are not, except where noted.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own devotional use. You may not sell, sublicense, or commercially exploit the Service or its content without our written permission.

The store and purchases

Some features let you purchase books or other items. Payments are processed by Stripe; by making a purchase you also agree to Stripe's terms. Prices, availability, and descriptions may change. Unless stated otherwise or required by law, sales are subject to our order and refund practices as communicated at checkout. You are responsible for any applicable taxes and for providing accurate order information.

Notifications

If you enable reminders or notifications, you consent to receiving them. You can turn them off at any time in the app or your device settings.

Third-party services

The Service relies on third parties such as Amazon Web Services, Stripe, and Firebase, and may link to third-party websites. We are not responsible for the content or practices of third parties. Your use of their services is governed by their own terms and privacy policies.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that devotional content is free of error. Mercy Through Mary supports, but does not replace, the sacramental and pastoral life of the Church.

Limitation of liability

To the fullest extent permitted by law, Mercy Through Mary and its volunteers, staff, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnity

You agree to indemnify and hold harmless Mercy Through Mary from any claims, damages, or expenses arising out of your misuse of the Service or your violation of these Terms or the rights of others.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnity — will survive.

Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, notify you in the app or by email. Your continued use of the Service after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the United States and of the state in which Mercy Through Mary is established, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts located there, unless applicable law grants you the right to bring a claim elsewhere.
